Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day

on which you, or a third party named by you who is not the carrier, took possession of the goods;
in the case of a contract for multiple goods that you have ordered as part of a single order and that are delivered separately, on which you, or a third party named by you who is not the carrier, took possession of the last goods;
in the case of a contract for the delivery of goods in several partial shipments or pieces, on which you, or a third party named by you who is not the carrier, took possession of the last partial shipment or the last piece.

by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract.

You may use the model withdrawal form provided below for this purpose. However, use of the model withdrawal form is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no case will you be charged any fees for this reimbursement.

We may refuse reimbursement until we have received the goods back, or until you have provided evidence that you have returned the goods, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract.

The deadline is met if you send the goods before the period of fourteen days has expired.

Returns and Return Label

Please contact us before returning the goods at info@evergold.de.

We will provide you with the return address intended for the respective goods and, where possible, provide you with a suitable return label.

In particular for larger or heavier goods, this allows us to use the commercial shipping rates available to us and avoid unnecessarily high return shipping costs.

Exercising your statutory right of withdrawal is not conditional on contacting us before returning the goods or using a return label provided by us.

Costs of Return Shipping

You shall bear the direct costs of returning the goods, provided that this is a return within the scope of the statutory right of withdrawal and the statutory requirements for this are met.

If we provide you with a paid return label for such a return, we will inform you of the costs incurred for this.

For goods that, due to their nature, cannot be returned by normal post, the return shipping costs communicated before the conclusion of the contract, or their estimate, shall apply.

The above provisions on return shipping costs apply exclusively to returns within the scope of the statutory right of withdrawal.

In the event of a justified complaint due to a defect, the statutory warranty rights apply. We shall bear the necessary costs of return shipping within the scope of statutory subsequent performance in accordance with the statutory provisions.

If you suspect a defect, please contact us before returning the goods at info@evergold.de.

We will coordinate the further procedure with you and provide you with the return address intended for the respective case. If a return is required, we will provide you with a suitable return label or arrange the return shipment.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their nature, characteristics and functioning.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply in particular to contracts for the delivery of goods

that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs;
that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
as well as in other cases provided for by law, in particular pursuant to Section 312g (2) of the German Civil Code (BGB).
