This confirmation of receipt does not yet constitute acceptance of the purchase offer unless acceptance is expressly declared therein. <\/p><p class=\"wp-block-paragraph\">(5) The purchase contract is concluded when we expressly accept the offer, confirm shipment of the goods, or deliver the goods to the customer.<\/p><h2 class=\"wp-block-heading\">\u00a7 4 Prices and Shipping Costs<\/h2><p class=\"wp-block-paragraph\">(1) For consumers, the prices stated in the online shop at the time of ordering apply, including the applicable statutory value-added tax, where applicable.<\/p><p class=\"wp-block-paragraph\">(2) For businesses, prices may also be shown as net prices plus statutory value-added tax, where so indicated.<\/p><p class=\"wp-block-paragraph\">(3) Additional shipping costs will be displayed to the customer before completing the order.<\/p><p class=\"wp-block-paragraph\">(4) For deliveries to countries outside the European Union, additional customs duties, import VAT, or other charges may arise. These are, where legally required, to be borne by the recipient and are not collected by us. <\/p><h2 class=\"wp-block-heading\">\u00a7 5 Payment Methods<\/h2><p class=\"wp-block-paragraph\">(1) The payment methods available in the online shop are displayed to the customer during the ordering process.<\/p><p class=\"wp-block-paragraph\">(2) Depending on availability, the following payment methods may be offered in particular:<\/p><ul class=\"wp-block-list\"><li>Advance payment by bank transfer<\/li>\n\n<li>PayPal<\/li>\n\n<li>Credit and debit card<\/li>\n\n<li>Other payment methods offered via payment service providers integrated into the online shop<\/li><\/ul><p class=\"wp-block-paragraph\">(3) For payment by advance payment, shipment is generally made after receipt of full payment.<\/p><p class=\"wp-block-paragraph\">(4) When using an external payment service provider, the respective contractual and payment terms of that provider apply in addition.<\/p><p class=\"wp-block-paragraph\">(5) We reserve the right not to offer individual payment methods, or to offer them only for certain orders, for legitimate reasons.<\/p><h2 class=\"wp-block-heading\">\u00a7 6 Delivery and Delivery Area<\/h2><p class=\"wp-block-paragraph\">(1) Delivery is made to the delivery address specified by the customer during the ordering process.<\/p><p class=\"wp-block-paragraph\">(2) The applicable delivery times and shipping costs are displayed on the product page or during the ordering process.<\/p><p class=\"wp-block-paragraph\">(3) Delivery is made by a suitable transport service provider selected by us.<\/p><p class=\"wp-block-paragraph\">(4) If a shipment cannot be delivered due to an incorrectly provided delivery address, culpable refusal of acceptance, or any other reason attributable to the customer, the customer may be charged the actual additional costs incurred, to the extent legally permissible.<\/p><p class=\"wp-block-paragraph\">(5) For consumers, the risk of accidental loss or accidental deterioration of the goods generally passes to the consumer only upon handover of the goods.<\/p><p class=\"wp-block-paragraph\">(6) For businesses, the risk passes, to the extent legally permissible, upon handover of the goods to the forwarding agent, carrier, or other third party designated to execute the shipment.<\/p><h2 class=\"wp-block-heading\">\u00a7 7 Retention of Title<\/h2><p class=\"wp-block-paragraph\">(1) The delivered goods remain the property of Evergold GmbH until full payment has been made.<\/p><p class=\"wp-block-paragraph\">(2) For businesses, we reserve title to the goods until all claims arising from the ongoing business relationship have been settled in full.<\/p><h2 class=\"wp-block-heading\">\u00a7 8 Right of Withdrawal for Consumers<\/h2><p class=\"wp-block-paragraph\">Consumers are generally entitled to a statutory right of withdrawal for distance contracts.<\/p><p class=\"wp-block-paragraph\">Details on the conditions, deadlines, exercise, and consequences of withdrawal, as well as the model withdrawal form, can be found in our separate <strong><a href=\"https:\/\/evergold.de\/en\/cancellation-policy\/\" data-type=\"page\" data-id=\"8100\">withdrawal instructions<\/a><\/strong>.<\/p><p class=\"wp-block-paragraph\">The right of withdrawal applies exclusively to consumers. Statutory exceptions to the right of withdrawal remain unaffected. <\/p><h2 class=\"wp-block-heading\">\u00a7 9 Voluntary Return Policies<\/h2><p class=\"wp-block-paragraph\">A voluntary return or take-back period beyond the statutory right of withdrawal exists only if expressly offered for the respective product or as part of a special promotion.<\/p><p class=\"wp-block-paragraph\">A voluntary return policy does not affect the customer&#8217;s statutory rights, in particular the right of withdrawal and statutory rights in respect of defects.<\/p><h2 class=\"wp-block-heading\">\u00a7 10 Liability for Defects and Warranties<\/h2><p class=\"wp-block-paragraph\">(1) The statutory rights in respect of defects apply unless otherwise effectively agreed below.<\/p><p class=\"wp-block-paragraph\">(2) For consumers, the statutory rights in respect of defects apply.<\/p><p class=\"wp-block-paragraph\">(3) For businesses, the limitation period for claims in respect of defects is generally twelve months from delivery of the goods, to the extent such reduction is legally permissible.<\/p><p class=\"wp-block-paragraph\">(4) The above reduction does not apply in particular to claims arising from damage resulting from injury to life, body, or health, in cases of intentional or grossly negligent conduct, or in other cases where a reduction is legally excluded.<\/p><p class=\"wp-block-paragraph\">(5) Where an additional manufacturer&#8217;s or seller&#8217;s warranty is offered for a product, its scope, duration, and conditions are set out in the respective warranty statement.<\/p><p class=\"wp-block-paragraph\">(6) An additional warranty does not limit the customer&#8217;s statutory rights in respect of defects.<\/p><h2 class=\"wp-block-heading\">\u00a7 11 Liability<\/h2><p class=\"wp-block-paragraph\">(1) We are liable without limitation for damages based on intent or gross negligence, as well as for damages resulting from injury to life, body, or health.<\/p><p class=\"wp-block-paragraph\">(2) In the event of slightly negligent breach of material contractual obligations, we are liable only for the damage typical for the contract and foreseeable.<\/p><p class=\"wp-block-paragraph\">Material contractual obligations are those obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance the contracting party may regularly rely.<\/p><p class=\"wp-block-paragraph\">(3) Mandatory statutory liability provisions, in particular under the Product Liability Act, remain unaffected.<\/p><h2 class=\"wp-block-heading\">\u00a7 12 Information on Batteries and Electrical and Electronic Equipment<\/h2><p class=\"wp-block-paragraph\">Batteries, accumulators, and waste electrical and electronic equipment must not be disposed of with unsorted household waste, to the extent statutory provisions require separate collection.<\/p><p class=\"wp-block-paragraph\">Where corresponding statutory information or take-back obligations exist for the products we offer, we provide the necessary information separately in the online shop, in particular under our <strong>disposal instructions<\/strong>.<\/p><h2 class=\"wp-block-heading\">\u00a7 13 Transport Damage<\/h2><p class=\"wp-block-paragraph\">If goods are delivered with obvious transport damage, we ask the customer to report such damage to the carrier as promptly as possible and to inform us without delay.<\/p><p class=\"wp-block-paragraph\">Failure to make such a complaint or notification has no effect on consumers&#8217; statutory claims or their enforcement.<\/p><p class=\"wp-block-paragraph\">For businesses, the statutory obligations to inspect and give notice of defects apply in addition, to the extent applicable.<\/p><h2 class=\"wp-block-heading\">\u00a7 14 Contract Text, Input Correction, and Contract Language<\/h2><p class=\"wp-block-paragraph\">(1) Before submitting the order, the customer can review and correct their entries using the technical functions provided in the online shop.<\/p><p class=\"wp-block-paragraph\">(2) After receipt of the order, the customer receives the essential order data electronically at the email address provided by them.<\/p><p class=\"wp-block-paragraph\">(3) Information on the storage and accessibility of the contract text is made available to the customer during the ordering process.<\/p><p class=\"wp-block-paragraph\">(4) The contract language is German.<\/p><p class=\"wp-block-paragraph\">Where translations are provided, in particular in English or French, these serve to improve comprehension. To the extent legally permissible, the German version shall prevail in the event of discrepancies. <\/p><h2 class=\"wp-block-heading\">\u00a7 15 Vouchers and Discount Promotions<\/h2><p class=\"wp-block-paragraph\">(1) Vouchers and discount codes can only be redeemed under the conditions specified in each case and within their respective validity period.<\/p><p class=\"wp-block-paragraph\">(2) Unless expressly stated otherwise, cash payment of vouchers or discounts is excluded.<\/p><p class=\"wp-block-paragraph\">(3) Multiple vouchers or discount codes can only be combined if this is expressly permitted.<\/p><p class=\"wp-block-paragraph\">(4) Special promotion terms are communicated to the customer in connection with the respective promotion.<\/p><h2 class=\"wp-block-heading\">\u00a7 16 Data Protection<\/h2><p class=\"wp-block-paragraph\">Information on the processing of personal data can be found in our separate <strong>privacy policy<\/strong>.<\/p><h2 class=\"wp-block-heading\">\u00a7 17 Consumer Dispute Resolution<\/h2><p class=\"wp-block-paragraph\">Evergold GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer dispute resolution body.<\/p><h2 class=\"wp-block-heading\">\u00a7 18 Applicable Law and Jurisdiction<\/h2><p class=\"wp-block-paragraph\">(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.<\/p><p class=\"wp-block-paragraph\">(2) For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.<\/p><p class=\"wp-block-paragraph\">(3) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for disputes arising from the contractual relationship is, to the extent legally permissible, the registered office of Evergold GmbH.<\/p><p class=\"wp-block-paragraph\">(4) For consumers, the statutory rules on jurisdiction apply.<\/p><h2 class=\"wp-block-heading\">\u00a7 19 Final Provisions<\/h2><p class=\"wp-block-paragraph\">Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
